Privacy Policy

This Privacy Policy (“Privacy Policy”) describes the privacy practices of Furthermore LLC (“Furthermore”) in connection with the websites made available by Furthermore LLC (“Furthermore”), and any applications designed for download and use on mobile, tablet, smart watch and other personal devices which may also be made available by Furthermore, including all features, functionalities, services and content of such websites and applications and any applications (collectively, “Digital Properties”).  By using the Digital Properties, you are acknowledging that you have read and understand and are agreeing to the terms and conditions of this Privacy Policy and expressly consent to our collection, use and disclosure of your personal information, as described in this Privacy Policy.

We use the personal information collected through the Digital Properties in an effort to enhance your experience with Furthermore and improve our offerings.  This Privacy Policy is intended to describe the personal information that is collected from users of the Digital Properties and how that information is used and disclosed by or on behalf of Furthermore.

This Privacy Policy may change as we continue to evolve Furthermore and the Digital Properties or any portion thereof. If we change this Privacy Policy, we will post the revised document here, and such changes will be effective immediately upon that posting.  Your continued use of the Digital Properties constitutes your acceptance of such changes and agreement to be bound by the modified Privacy Policy.  Accordingly, we recommend that you review this Privacy Policy periodically when accessing or using the Digital Properties.

What information we collect and how:

When you access and use the Digital Properties, we may directly or indirectly collect information that identifies or relates to you, which includes, without limitation:

Contact and Demographic Information: Information on how to contact you, including your e-mail address, but from time to time you may also provide to us your name, mailing address, zip code, mobile or other phone number and certain demographic information such as date of birth, age and gender.

We most commonly collect your contact and demographic information directly from you, when you chose to provide it with us – for example, by signing up for a mailing list or emailing our Editors with question – or when you chose to interact with our Digital Properties – for example, by completing a survey.  We may also collect your contact and demographic information from third parties, including without limitation our sweepstakes and advertising partners, social media networks, our service providers and publicly available records.

Digital Account Registration: If you are a member and establish an account on the Digital Properties we will collect your username, password, and membership number, as well as any other information you provide in connection with your Digital Properties account and account preferences, such as a profile picture and your preferred club locations.  If you have established a Digital Properties account, you may log in to it in order to review and update your information and preferences.

Comment Information: Information you choose to provide when using features of the Digital Properties which allow you to comment on content or otherwise submit commentary, feedback, recommendations, ratings or other items through the Digital Properties (collectively, “Comment Features”).  Please use caution when posting through Comment Features, as all information posted to these portions of our Digital Properties, including any user ID or profile picture associated with your comment, is public information and may be read, collected and used by other Digital Property users.

Usage Information: Information about your Internet connection, browser, computer or mobile or other device, your IP address or device ID, device or geographic location, traffic sources, and information on how you use and interact with the Digital Properties, such as the pages, features or content you access. When you access the Digital Properties, we may also collect certain information such as website usage patterns and statistics automatically through the use of cookies and other technologies. Technical Information: When you use the Digital Properties, we may automatically collect information about your Internet connection, browser, or computer/device, including IP address or device ID, browser type, operating system information, time zone, device geo-location data, clickstream information, page response times, and download errors. 

Social Media and Third Party Apps: If you link your social media profiles and accounts to the Digital Properties, or otherwise interact with the Digital Properties through social media networks (e.g., by sharing content through your social media account), information may be made available to, and collected by, the Digital Properties and Furthermore through those social media profiles and accounts.

How we use personal information:

We use the personal information collected through our Digital Properties to provide you with the content, services and offerings you request, to deliver a more relevant and curated experience with the Digital Properties and relationship with Furthermore, and to satisfy our other business purposes and needs. This may include, without limitation, using that information in connection with:

Transaction Fulfillment: Providing you with the offerings, content, services, or information you have requested, and responding to your inquiries, requests and comments. This may include, without limitation, sending you the Furthermore content to which you subscribed, entering you in a sweepstakes and responding to your inquiries.

Promotional Purposes: Providing you with special offers, promotions and information about Furthermore and offerings to you, primarily via email.  We may also send you newsletters, information and promotions regarding our affiliates and their services, products and offerings, including without limitation regarding EQUINOX-branded affiliates.  The promotion materials we may send you may also give you information and offers regarding third parties who are our business and promotional partners; these may include, without limitation, other businesses that help us co-host a sweepstakes, or businesses for whom we have developed an advertising campaign. 

If you wish to stop receive Furthermore mailings to which you subscribed, or otherwise do not wish to receive promotional emails from Furthermore, you can opt out of future mailings by clicking on the unsubscribe link located on the bottom of the relevant promotional email.  Although we strive to update our email list as frequently as possible, you might receive another promotional email before we are able to remove you from our lists.

Personalized Experience: Delivering a more relevant and curated experience to Furthermore subscribers and visitors of the Digital Properties, including without limitation by recommending content and/or advertisements we think these individuals may enjoy.  As part of our efforts to provide our audience with a more personalized experience, we may combine the personal information we have collected through the Digital Properties with other information that we have received from other sources and third parties.  If you are an Equinox member, this may include information collected by Equinox Holdings, Inc. in the course of your membership and relationship with Equinox, including, without limitation, information regarding check-ins, class or session bookings, and other information you chose to provide when completing assessments and questionnaires regarding physical health, nutrition and fitness goals.

Business Purposes and Research: We use personal data for our legitimate business purposes, including: to operate, evaluate and improve our business and services; develop new businesses, services and solutions; perform market research; advertise and market our business, services and solutions; determine the effective ness of our advertising and marketing; analyze our businesses, services, solutions and Digital Properties; and improve our security administer the Digital Properties. This may include aggregating information regarding you across our entire user base or part of our user base.

We may also use your personal data to protect us against and prevent fraud, claims, and other liabilities and to comply with or enforce applicable legal requirements, industry standards, and our policies and terms.  We use personal data for these purposes when it is necessary to protect, exercise or defend our legal rights, or when we are required to do so by a law that applies to us.

We do not use personal data to make decisions based solely on automatic processing in any way that would produce legal effects concerning you or otherwise similarly significantly affect you.

If we plan to use the Personal Data that you provide to use for other purposes, we will provide an additional privacy notice to you to describe the purposes for which we will use the Personal Data and, as may be required by applicable law, our legal basis for doing so.

Compliance and Protection: Complying with our obligations under law and protecting the rights, property or safety of Furthermore, its affiliates, employees, subscribers, users and others.  This may include enforcing or applying our Terms of Use and other agreements and cooperating with any legal process or investigate or governmental requires.

How we share information:

Except as described in this Privacy Policy or in other situations where we have provided you with clear prior notice, Furthermore does not sell, rent or otherwise share your name, e-mail address, or any other personal information regarding you to unaffiliated third parties. We may, however, share information for the following reasons and with the following persons:

Affiliates: We may share your personal information with Furthermore’s affiliates, including Equinox Holdings, Inc., as part of our and our affiliates’ efforts to provide a more personalized experience. These affiliates may combine the personal information we have shared with other personal information they have collected regarding you.  If you are an Equinox member, this may include receiving and using information about your Furthermore subscriptions and preferences in an effort to improve and customize your experience by Equinox, such as by recommending classes or services.

Agents and Service Providers: We employ other companies and individuals to perform functions on our behalf.  Examples include, without limitation, creating and maintaining our Digital Properties, sending e-mails, managing and updating subscriber lists, analyzing data, providing marketing assistance. These service providers may have access to your personal information in order to perform their functions, but are not permitted to use it for other purposes.

Sweepstakes and Promotional Partners: When you enter or participate in a sweepstakes, contest or other special offer or campaign sponsored by Furthermore, the information you provide may be disclosed to Furthermore’s promotional partners for such sweepstakes, contest, offer or campaign.  If this will happen, we will notify you of this sharing at the time of entry.  If you do not want any personal information shared, you should not participate in the sweepstakes, contest, offer or campaign. Please understand that promotional partners will use your information used under their privacy policies; we encourage you to read the privacy polices of these promotional partners, as their practices may differ from ours. Compliance and Protection: We reserve the right to disclose any personal information we have concerning you if we determine doing so is necessary or desirable to: comply with our obligations under the law or in connection with any legal process or investigative or governmental requests; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Furthermore, its affiliates, employees, subscribers, users, or others.  This includes exchanging information with other companies and organizations for fraud protection, as well as providing information to law enforcement and governmental authorities.

Corporate Transactions: In the event of a reorganization, merger or sale of Furthermore or any of its affiliates, we may transfer any and all personal information we have collected to the relevant third party.

Aggregated Information: We may also share aggregated statistical data with partners that includes your demographic or other information but does not identify you.  We reserve the right to provide any and all such aggregated and de-identified data to third parties.

Use of cookies:

We collect certain information by automated means when you visit the Digital Properties, through various means such as "cookies," "web beacons" and IP addresses, as described below.  A “cookie” is a small text file that a website saves on your computer or mobile device when you visit the site. We use cookies to tell us whether you have visited us before or if you are a new visitor.  We also use cookies to help us identify site features in which you may have the greatest interest. Targeting and Advertising: These help customize the content and information you receive on the site and to help deliver ads that we believe are relevant to your interests.   • DoubleClick: The IDE cookie  set on our website to help identify a Google user as someone who visited our website so that we can determine whether or not to show that user an Equinox ad via Google’s DoubleClick ad services, and to improve reporting on campaign performance.
